Public offer
Contract for the distance sale of goods. It sets out the terms of ordering Clean Kitty litter and the buyer’s rights.
This is an English translation for convenience. The legally binding version is the Ukrainian text of this page; it prevails in case of any discrepancy.
1. General provisions and terms
This public offer is a proposal by Individual Entrepreneur Hlib Turoliev (FOP Turoliev H. O.) (the Seller) to conclude a contract for the sale of goods via the Clean Kitty website. The Buyer is the person placing an order on the website. The Goods are the Clean Kitty litter presented in the catalog. The Order is the selected goods, their quantity, and the payment and delivery details.
Acceptance means agreeing to this offer by placing an order on the website: filling in the required details and pressing the “Confirm order” button. Once the order is successfully placed, the contract is deemed concluded. Before pressing the button, the Buyer can check and correct the details and read this offer via the link under the button.
The contract is governed by the Civil Code of Ukraine and the Laws of Ukraine “On Electronic Commerce” and “On Consumer Rights Protection” as amended. An order is subject to the terms in force when it was placed. These terms do not limit the mandatory consumer rights established by law.
2. Subject of the contract
The Seller undertakes to deliver Clean Kitty litter to the Buyer according to the order, and the Buyer undertakes to pay for and accept the goods. The name, characteristics, quantity and contents are determined by the product description on the website and the placed order.
3. Placing an order
The Buyer adds goods to the cart, chooses the quantity and payment method, and enters their first name, last name, phone, email, city and Nova Poshta branch or parcel locker, or the postal code and Ukrposhta branch. The Buyer is responsible for the accuracy of these details. A comment or a request for a call back can be added if needed.
After the order is placed, the website shows the order number. A confirmation is sent to the email provided: for cash on delivery — after the order is placed; for card payment — after LiqPay confirms the payment. If the email has not arrived or the details need correcting, contact the Seller and quote the order number. The absence of an email does not by itself cancel a successfully placed order.
4. Price
Prices are in Ukrainian hryvnias (UAH) as shown on the website when the order is placed. The total, including any discount applied, is shown in the cart before confirmation. A change of price on the website does not change the amount of an order already placed. The Seller is not a VAT payer.
Delivery is included in the price. We ship every working day; delivery time depends on the carrier’s schedule. Delivery terms apply as shown on the website at the time of the order.
5. Payment
- By card online via LiqPay when placing the order.
- Cash on delivery via Nova Poshta when receiving the goods. For delivery by Ukrposhta, only online card payment is available.
The money transfer fee for cash on delivery is not included in the price of the goods and delivery and is paid at the rates of the respective payment service. A payment document is provided in accordance with the laws of Ukraine, including in electronic form where required by law.
6. Delivery
Delivery is made, at the Buyer’s choice, by Nova Poshta (to a branch or parcel locker) or by Ukrposhta (to a branch by postal code). Delivery is included in the price. We ship every working day; delivery time depends on the carrier’s schedule. The actual time also depends on the carrier’s operations. The risk of accidental damage or loss passes to the Buyer upon actual receipt of the goods by the Buyer or their authorized person.
When collecting the parcel at the branch, check the packaging, the quantity and that the goods match the order. If damage or a mismatch is found, record it with the carrier’s staff and notify the Seller. Such a check helps resolve the issue but does not deprive the Buyer of legal rights regarding defects that could not be detected on receipt.
7. Returns and exchange
The Buyer has the right to return or exchange goods and to withdraw from a distance contract in the cases and within the periods established by the laws of Ukraine, including within 14 days in the cases provided by law. To do so, contact the Seller with the order number and the reason. The procedure is described on the “Returns policy” page. In case of any conflict with these rules, the mandatory provisions of law apply.
8. Personal data
The Seller processes the data provided by the Buyer to process, pay for and deliver the order, to contact the Buyer and to comply with the law. The processing procedure, the transfer of necessary data to the carrier and payment services, and the Buyer’s rights are described in the Privacy policy.
9. Liability, force majeure and disputes
The parties are liable for non-performance or improper performance of the contract under the laws of Ukraine. If extraordinary and unavoidable circumstances prevent a party from fulfilling its obligations, that party notifies the other and confirms their impact on the specific obligation in the manner established by law. The existence of such circumstances does not automatically cancel obligations and does not deprive the consumer of legal rights.
The parties first try to resolve a dispute by contacting the Seller and negotiating. If no agreement is reached, the dispute is resolved by a court under the laws of Ukraine. The Buyer may also contact the authorized consumer protection authorities.
